Terms & Conditions of Agreement

Definition

The following definitions refer to the ‘contract’ (Sorelli Ensemble booking agreement) and these ‘terms and conditions’. Julia Cracknell is the ‘Ensemble Leader’, the booker is ‘the client’ and the proposed musicians appearing as the Sorelli Ensemble are ‘the artists’

1. Booking

1.1  Bookings are only confirmed upon signature and return of this agreement.

1.2 The contract may be modified/altered upon agreement from both Client & Ensemble Leader, in advance of the event date.

1.3 The agreed total amount may vary with any alterations made to the booking.

1.4 All bespoke musical arrangements must be agreed upon at least 4 weeks prior to the event date. If these are not confirmed within this time scale, they will not be completed.

1.5 Payment of these arrangements will be added to the remaining balance.

1.6 In the case of Client cancellation, payment will be required for any arrangements already completed

2. Payment of booking fees

2.1 A non-refundable deposit of 50% of the performance fee is required upon signature of this agreement to secure your date. The payment is required to be paid by bank transfer to the account given on the agreement

2.2 It is agreed that all remaining costs for the Engagement listed above shall be payable no later than 4 weeks prior to the date of the engagement.

3. Client cancellation

3.1 If a Client cancels their event after full payment has been made and within 4 weeks of the event date, for any reason other than ‘force majeure’ (clause 8) no refund will be offered

3.2 The deposit of 50% is a non-refundable one and will not be offered back in any case including ‘force majeure’

4. Artist cancellation

4.1 The Artists may not cancel the booking for any reason other than ‘force majeure’ (clause 8)

4.2 In the event of ‘force majeure’, the Ensemble Leader will contact the client as soon as possible and will make every attempt to find suitable replacements. Should this not be possible, a refund of any payment made shall be given

5. Responsibilities of the client

5.1 The Client shall ensure that a secure room is available for the Artists and their property at the event venue

5.2 The Client shall not make or permit the making of any audio and/or visual recording or transmission of the Artists’ performance without prior written consent

5.3 If asked to play outside, a sheltered area will be provided for the Artists and their instruments. Under no circumstance will artists play in conditions such as strong sunlight, rain or very cold weather

5.4 Free parking should be available to the Artists. If no free parking is available, the Client is liable to these costs. Any relevant receipts will be presented to the client within 7 days of the event date

5.5 For bookings of 4 hours and over, a hot meal is requested for the Artists

6. Responsibilities of the Artists

6.1 All Artists appearing as ‘The Sorelli Ensemble’ will have Public Liability Insurance and can provide certificates if necessary

6.2 The Artists shall present themselves in a professional manner and will wear elegant black dress unless otherwise requested

6.3 The Artists will endeavour to arrive at their booking 1 hour prior to their start time

6.4 Performance periods are broken down into 45-50 minute sets with 10 minute breaks taken in between

6.5 Booking fees are based on the time spent at the event, not only the performance time. These costs are for the period between the start time and the end time at your event

7. The use of a deputy performer/s

7.1 The listed ‘Sorelli’ players will make their best efforts to perform at all of their bookings however they also have a roster of players whom they call upon to step in for them should they become unavailable.

7.2 If, due to unforeseen circumstances or illness, these listed players are not available, the Ensemble Leader shall call upon other players to step in as deputies. These performers shall have equal ability and competence and will represent the Sorelli Ensemble in the same style and professionalism as displayed on all promotional material

7.3 The Ensemble Leader holds the right to use one or more Deputy performers without notifying the client but will always attempt to notify the Client out of courtesy

8. Force Majeure

8.1 Force Majeure occurs where either party is unable to comply with the contractual agreement set out in these terms and conditions due to a reason out of their control. This could be due to illness or unforeseen reasons beyond their control.

8.2 In the event of a musician/musicians being unable to attend due to illness or unforeseen reasons beyond their control, the Band Leader shall use their best endeavours to obtain a deputy/deputies or perform either on their own or as the ensemble that was booked. In the extreme event of being unable to provide any music at all, the Band leader’s liabilities shall be limited to returning the total sum paid by the client. If the event is cancelled due to a force of nature, the client will have the right to change the date of the booking to one in the future at no extra charge but all paid moneys shall be non-refundable.

9.  Extension of booking on the day

9.1 If the Client wishes to extend the booking on the day of the event, the Client will be charged £30 per player for every extra 30 minutes and will be requested to pay the Artist directly or will be invoiced for this within 24 hours of the event.
